5. PRIVACY POLICY

Smart Rent secures the integrity and confidentiality of the personal data in its possession or under its control by implementing appropriate and reasonable technical, physical and organisational measures to prevent the following, amongst others:

  • Accidental loss of, damage to, or unauthorised destruction of users' personal information.
  • Unlawful or unauthorised processing of users' personal information.
  • Unlawful and unauthorised access to users' personal information.
  • Unlawful or unauthorised use of users' personal information.

Implementing reasonable and appropriate technical, physical, and organisational security measures to protect against the identified risks, Smart Rent takes reasonable precautions to regularly identify and assess all reasonably foreseeable internal and external risks to personal data in its control and under its possession. We respect your right to privacy, it is important to us, and we take the protection of your privacy and ensuring the security of your personal information so seriously. Emphatically, we are committed to the fair and transparent processing of your personal information in line with the provisions of the Nigerian Data Protection Act (NDPA) 2023, as well as other data protection regulations.

5.1. The data that Smart Rent may collect and keep of its users

Protecting the privacy, confidentiality and security of your personal information is very important to us as it is critical for us to maintain your trust and act in the right way to meet your needs. We have therefore implemented Group-wide policies and procedures to ensure that your personal information is protected. For the purpose of transacting business with Smart Rent, it shall collect the following data of its users:

  • Name: this includes official/Government names of users, as well as every alias (A, K. A.) attaching therefrom.
  • Means of Identity: this particularly refers to National Identification Number (NIN) either in the slip form or plastic card form, in verification of users’ identity.
  • Date of Birth (D. O. B.): this is for the verification of users’ official age and in compliance with rent and title to property laws operational across Nigeria.
  • Address: this is for service purpose, amongst every other purposes for which a person’s address would be requested. This could be both physical address and email address.
  • Property document: this concerns properties with long term lease, say above three years.
  • Others may include: gender, sex, financial information including with regards to financial behaviour, goals and needs; information about associations or relationships between individuals or corporate entities that can confirm your identity; your photographs, CCTV and video recordings of you and other identifiers, say Tax Identification Number (TIN), etc.

5.2. How we collect your personal information

We will collect your personal information directly from you or by telephone or through online channels such as our website, mobile applications, or electronic messaging platforms. We may also collect personal information about our users from other sources where lawful and reasonable, such as reputable third parties that users deal with or that Smart Rent interacts with for the purpose of conducting its business. These third parties include:

  • Parents or guardians, especially of minors (individuals under 18 years of age).
  • Employers, advisers, agents, associates, assignees, successors in title, trustees, executors and appointed third parties (including legal practitioners and contractors).
  • Government departments, regulatory authorities, courts of law, law enforcement agencies, and tax authorities.
  • Business Partners, etc.

5.3. How your personal information is protected

The security of your personal information is important to us and we take reasonable steps in keeping your personal information safe and to prevent loss, destruction of and damage or unauthorised access to your personal information by unauthorised parties. We therefore require the same level of security to be implemented by our service providers and third parties. However, users must not share or send us any personal information through any unauthorised channel, as these are unsecure means of communication and carry a risk of interception and unauthorised access. Users should only share personal information through our authorised communication channels, against which Smart Rent shall not be liable in any form.

5.4. Validity period, storage and disposal of data collected of Users

  • Every data that Smart Rent will keep of its users shall be those given by the users and nothing more.
  • In compliance with Data Protection Legislations, Smart Rent will request and get ‘extra’ data of its users and, users shall be obliged to offer same.
  • Every data collected by Smart Rent of its users shall not have a specified storage period.
  • Every data collected by Smart Rent of its users shall be safeguarded by Smart Rent within the necessary Data Protection Legislations.
  • Smart Rent reserves the right to dispose of any user’s data as soon as its transaction with the user is completed, subject to its discretion.
  • Smart Rent shall not be liable for any use or misuse of users’ information after a valid disposal.

5.5. Third-Party Links

From time to time, our platforms may include links to third-party websites, plug-ins and applications. It should categorically be known that clicking on those links or enabling those connections may allow third parties to collect or share data about you. We do not control these third-party websites and are not responsible for their privacy statements. Whenever you leave our platform, we encourage you to read the privacy policy of every website you visit.

5.6. What are your rights?

We value your trust and want you to be familiar with your rights under the Data Protection Legislations, and to know how you can exercise them in your interactions with Smart Rent Nigeria. You have the right to:

  1. Request access to the personal information we hold about you;
  2. Request correction of your personal information, where applicable. This enables you to have any incomplete or inaccurate data we hold of you corrected or updated, though we may need to verify the accuracy of the new data you provide us with;
  3. Object to processing of your personal information where it is not pending the resolution of a public interest or other legitimate grounds request which override your rights and freedoms, and establishment, exercise, or defense of legal claims.
  4. Withdraw consent, where applicable from Smart Rent using your personal information for any reason;
  5. Request that we delete your personal information
  6. Note, however, that we may not always be able to comply with your request for deletion for legal or regulatory compliance reasons which will be notified to you, if applicable, at the time of your request.
  7. Be notified that your personal information is being collected by us or has been accessed or acquired by an unauthorized person;
  8. Object to the further processing of personal information e.g. direct marketing. In some cases, we may demonstrate that we have compelling legitimate grounds to process your information which override your rights and freedoms.;
  9. Request for the transmission of the personal data to another third party under certain circumstances. Once transferred, the other party will be responsible for safeguarding such personal data.
  10. Note however, that this right only applies to information which you initially provided consent for us to use or where we used the information for sealing a contract with you.
  11. Enquire on the type of personal information collected, source of personal information collected, storage, processing purpose, and other recipients of the data.
  12. Lodge a complaint with the Data Protection regulator; the Nigerian Data Protection Commission (NDPC) whenever you feel your personal information is wrongly in use.
